QLD: Child porn charge against ombudsman defeated
A Commonwealth ombudsman charged with possessing child pornography has been acquitted in a
Brisbane Court on the basis that evidence against him was obtained illegally.
42-year-old KEVIN BRIAN O'KELLY, of Acacia Ridge, in Brisbane's south had pleaded NOT
guilty to possessing child abuse magazines at his home on April 30 last year.
O'KELLY was raided by Australian Federal Police agents who wanted to inspect his computer,
and they seized 75 x-rated videos and four child abuse magazines.
He was charged over the magazines, which dated back to the 1970s.
But Senior Magistrate DI FINGLETON has ruled in the Brisbane Magistrates Court that the
magazines were obtained illegally by the federal police.
She dismissed the charge and ordered police pay O'KELLY'S legal costs which totalled
$1,000.
